Ontario employers must provide either working notice or pay in lieu when terminating employees without cause. The Employment Standards Act, 2000 sets minimum requirements, but common law reasonable notice entitlements are often substantially higher. Employers should also consider human rights implications, potential claims, and proper documentation before proceeding with any termination.

Human Rights Tribunal of Ontario complaints require careful, timely responses. Employers must file a response within prescribed deadlines, gather relevant documentation, and develop a defence strategy.
