Ontario’s Cash Bail Proposal Under Scrutiny
On November 24, 2025, the Ontario government announced plans to table legislation requiring accused persons to pay cash security deposits upfront upon release, a significant departure from the current bail system where payment is only required if conditions are breached.
Speaking to National Magazine in her capacity as Vice-President of the Criminal Lawyers’ Association, Jessyca Greenwood raised serious concerns about the proposal’s constitutionality, citing the Supreme Court of Canada’s landmark 2017 decision in R. v. Antic.
